Cross-Lease Fixable with Written Consent of Neighbour

Cross-Lease Flow Chart

Background

The title for this cross-lease is shown on the left and the current outline of the property is shown on the right. Look the same? Not quite.

Deck extension

The owners completed a deck extension circa 2008.

So, what happened? How did they fix it?

The owner of Flat 1 received a written letter providing their consent to the deck extension. This is a requirement under most cross-leases.

‍

Example letter

Dear [insert Flat 1’s owners]

We, [insert neighbours name], as owners of [Flat 2] [record of title] consent to the deck being extended in Flat 1’s restricted area.
